Terms of Service

Please read these Terms of Service carefully before using MealMain.

1. Acceptance of Terms

By creating an account, downloading, or using MealMain ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our Service. These Terms apply to all users of the Service. You must be at least 13 years of age to use MealMain. By using the Service, you represent that you are at least 13 years old. If you are under 18, you confirm that you have your parent or guardian's permission to use the Service.

2. Description of Service

MealMain is a meal planning and recipe platform that helps users discover recipes, plan meals, track nutrition, create shopping lists, and connect with food creators. The Service includes: (a) Free Tier: Recipe browsing, basic recipe saving, shopping list, and social features; (b) Premium Subscription: Full meal planner, nutrition tracking, advanced analytics, and an ad-free experience; (c) Creator Programme: Tools for approved creators to publish and manage recipe content. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. User Accounts and Registration

To access certain features, you must register for an account. You agree to: (a) Provide accurate, current, and complete information during registration; (b) Keep your account information up to date; (c) Maintain the security of your password and not share it with others; (d) Be responsible for all activities that occur under your account; (e) Notify us immediately at support@mealmain.com if you suspect unauthorised access to your account. We reserve the right to refuse registration or cancel accounts at our discretion, including where we believe information provided is inaccurate or the account is being used in violation of these Terms.

4. User Content and Community Standards

Users may create, upload, and share recipes, comments, and other content ("User Content"). You retain ownership of your User Content, but by posting it you grant MealMain a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute it within the Service. All User Content must: (a) Be your original work or content you have the right to share; (b) Be accurate and not deliberately misleading; (c) Comply with all applicable laws. User Content must NOT: (a) Infringe the intellectual property rights of any third party; (b) Contain spam, unsolicited advertising, or self-promotional links unrelated to the content; (c) Include harassment, bullying, hate speech, or discrimination based on race, gender, religion, nationality, disability, or sexual orientation; (d) Contain sexually explicit, violent, or otherwise inappropriate material; (e) Impersonate another person or misrepresent your affiliation; (f) Promote dangerous diets, eating disorders, or harmful health practices; (g) Make false medical or health claims. We reserve the right to remove any User Content that violates these standards without notice. Content Restrictions: Where a user's content or behaviour violates these community standards, MealMain may apply a content restriction to their account. A content restriction limits the ability to post or update publicly visible content (including recipes, profile pictures, and comments) for a specified period or indefinitely, while preserving full access to all other app features. Content restrictions may be applied at MealMain's sole discretion and do not constitute termination of the Service. If you believe a content restriction has been applied in error, please contact us at support@mealmain.com.

5. Creator Standards

Creators are users approved to publish recipes and content on MealMain. By participating in the Creator Programme, you agree to the following additional standards: (a) Recipe Accuracy: All recipes must be your original creation or properly attributed. Ingredient quantities, cooking times, and instructions must be accurate to the best of your knowledge. (b) Nutritional Information: Any nutritional information provided is approximate and for general guidance only. Creators must not make specific medical or therapeutic claims about recipes. Recipes may note they are suitable for certain diets only where this is accurate. (c) Allergen Responsibility: Creators must clearly note common allergens present in recipes. However, MealMain does not verify allergen claims and users are responsible for verifying suitability for their own dietary needs. (d) Sponsored and Affiliate Content: If a recipe or post is sponsored or contains affiliate links, this must be clearly disclosed. Failure to disclose paid promotions may result in removal from the Creator Programme. (e) Prohibited Creator Content: Creators may not post content that promotes specific commercial products in a misleading way, makes unfounded health claims, or uses the platform to drive traffic away from MealMain to competing services. (f) Quality Standards: MealMain reserves the right to remove recipes or suspend creator accounts that consistently receive reports, produce inaccurate content, or otherwise damage the quality of the platform. (g) Verification: Recipes submitted for verification are reviewed by MealMain. Verified status may be revoked if content is found to be inaccurate or in violation of these Terms.

6. Health and Nutrition Disclaimer

MealMain provides nutritional information and meal planning tools for general informational purposes only. This information does not constitute medical advice and should not be treated as a substitute for professional medical, dietetic, or nutritional advice. (a) Nutritional data is based on standard food databases and is approximate. Actual nutritional content may vary based on specific ingredients, brands, preparation methods, and portion sizes; (b) MealMain does not endorse any specific diet, eating pattern, or nutritional approach; (c) If you have a medical condition, food allergy, or specific dietary requirement, you should consult a qualified healthcare professional before making significant changes to your diet; (d) MealMain is not responsible for any adverse health outcomes resulting from reliance on nutritional information within the Service.

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, incorporated into these Terms by reference, explains how we collect, use, and protect your information. By using MealMain, you consent to the collection and use of information as described in our Privacy Policy. Key points: We do not sell your personal information to third parties. Health and nutrition data you provide is used solely to personalise your experience within MealMain. We use your usage data internally to improve the Service and its recommendation features.

8. Subscription Services

MealMain Premium is a paid subscription providing access to advanced features. (a) Billing: Subscriptions are billed in advance on a monthly or annual basis through the payment provider shown at checkout. Prices are displayed at the point of purchase. (b) Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You authorise us or our payment provider to charge your payment method on file for each renewal. (c) Cancellation: You may cancel at any time through your subscription settings or payment provider account. Cancellation takes effect at the end of the current billing period and you retain access to premium features until that date. (d) Refunds: Refunds are governed by the payment platform and applicable law. MealMain does not directly issue refunds except where required by law. (e) Price Changes: We may change subscription prices with reasonable advance notice. Continued use after a price change constitutes acceptance of the new price. (f) Scope of Premium Subscription: MealMain Premium provides access to advanced meal planning, nutrition tracking, shopping list management, and an ad-free experience. The premium subscription does not guarantee unlimited or unconditional rights to post public content. Content posting is a feature of the Service subject to the community standards in Section 4. A content restriction applied under Section 4 does not entitle a premium subscriber to a refund, as the core meal planning and nutrition features of the subscription remain fully accessible. Content posting privileges are a conditional feature and not the primary purpose of the premium subscription.

9. Affiliate Links and Third-Party Products

MealMain may display affiliate links to third-party products and services, including kitchen equipment, food products, and grocery delivery services. These links are clearly identified within the Service. (a) When you click an affiliate link and make a purchase, MealMain may receive a commission at no additional cost to you; (b) Affiliate relationships do not influence editorial decisions about recipe content or recommendations; (c) MealMain does not endorse, warrant, or take responsibility for third-party products, services, or websites accessed through affiliate links; (d) Your transactions with third-party services are subject to their own terms and privacy policies; (e) We recommend reviewing the terms and privacy policy of any third-party service before making a purchase.

10. Intellectual Property Rights

The Service and its original content, features, functionality, branding, and design are the exclusive property of MealMain and its licensors, protected by copyright, trademark, and other applicable laws. (a) You may not copy, modify, distribute, or create derivative works from MealMain's proprietary content without our prior written consent; (b) Our name, logo, and trademarks may not be used without prior written permission; (c) User Content remains your property. By posting content, you confirm you have all necessary rights to grant us the licence described in Section 4.

11. Prohibited Uses

In addition to the content standards in Section 4, you may not: (a) Use the Service for any unlawful purpose; (b) Attempt to gain unauthorised access to any part of the Service or its infrastructure; (c) Use automated tools, bots, or scrapers to extract data from MealMain; (d) Interfere with or disrupt the integrity or performance of the Service; (e) Circumvent any access controls or use the Service to access features you have not paid for; (f) Transmit viruses, malware, or any other malicious code; (g) Use the Service to send unsolicited communications (spam); (h) Collect or harvest personal information about other users without their consent; (i) Use the Service in any way that could bring MealMain into disrepute.

12. Disclaimers and Limitation of Liability

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind. To the fullest extent permitted by applicable law: (a) MealMain makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the Service; (b) MealMain is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service; (c) Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to MealMain in the 12 months preceding the claim; (d) Nothing in these Terms limits liability that cannot be excluded under New Zealand law, including liability under the Consumer Guarantees Act 1993 where applicable.

13. Indemnification

You agree to indemnify, defend, and hold harmless MealMain and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

14. Termination

Either party may terminate your access to the Service: (a) You may terminate by deleting your account at any time through the account settings; (b) MealMain may suspend or terminate your account immediately and without prior notice if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law; (c) MealMain may also terminate accounts that have been inactive for an extended period, with advance notice; (d) On termination, your right to use the Service ceases. Sections that by their nature should survive termination will continue to apply. As an alternative to full account termination, MealMain may apply a content restriction (as described in Section 4) where a violation relates solely to public content. A content restriction is not a termination of the Service — it restricts only the ability to post publicly visible content (recipes, comments, and profile pictures) while all other features, including premium features, remain fully accessible. Content restrictions may be temporary or indefinite depending on the nature of the violation. We will endeavour to notify you of a content restriction via email or in-app notification where practicable.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to conflict of law provisions. (a) Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of New Zealand; (b) Before initiating any formal proceedings, we encourage you to contact us at support@mealmain.com to attempt to resolve any dispute informally; (c) If you are a consumer in a jurisdiction with mandatory consumer protection laws, those laws may give you additional rights that cannot be waived by these Terms.

16. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide at least 30 days notice by posting the updated Terms in the Service and notifying you via email or in-app or on-site notification. What constitutes a material change is determined at our reasonable discretion. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
